Terms of Service

Welcome to Roleplay Overlay, a service operated and managed exclusively by Andalucía:RP ("The Operator").

By using our application, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, accessing, or using Roleplay Overlay (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

2. Description of Service

Roleplay Overlay is a free, non-commercial overlay chat application designed for roleplay purposes in many games. The Service provides:

• Real-time text chat overlay functionality
• Server and team-based communication channels
• Scene-based private roleplay spaces
• Radio communication features
• Account verification via Roblox

3. No Data Storage - Message Policy

This means:

• We cannot retrieve past messages for any purpose
• Message history is not available after disconnection
• We have no record of what users communicate through the Service

4. User Responsibilities

As a user of Roleplay Overlay, you agree to:

• Use the Service only for lawful purposes
• Not transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Not impersonate any person or entity
• Not interfere with or disrupt the Service or servers
• Not attempt to gain unauthorized access to any portion of the Service
• Comply with Roblox Terms of Service while using our overlay
• Be at least 18 years of age

5. Disclaimer of Liability for User Content

We explicitly disclaim any and all liability for:

• Messages, content, or communications sent by users
• Any disputes between users
• Any harm, damage, or injury resulting from user interactions
• Content that violates third-party rights or applicable laws
• Any consequences of roleplay scenarios or content

Users engage with other users at their own risk. We strongly advise users to exercise caution and good judgment in all communications.

6. Report System

We maintain a community-based report system to help maintain a safe environment. Users can report inappropriate behavior or content through the in-app reporting feature.

Please note:

• Reports are reviewed by volunteer moderators
• We do not guarantee response times for reports
• The existence of the report system does not create any obligation or liability on our part
• We reserve the right to take action (including account suspension or ban) based on reports, at our sole discretion
• False or malicious reports may result in action against the reporting user

7. Account and Access

Access to Roleplay Overlay requires authentication through Roblox OAuth. You are responsible for:

• Maintaining the security of your Roblox account
• All activities that occur under your account
• Immediately notifying us of any unauthorized use of your account

We reserve the right to suspend or terminate access to the Service at any time, for any reason, without notice.

8. Intellectual Property

Roleplay Overlay and all related logos, designs, and content are the property of Andalucía:RP. Users may not:

• Copy, modify, or distribute any part of the Service
• Reverse engineer or attempt to extract source code
• Use our trademarks without explicit permission

Roblox and all related trademarks are the property of Roblox Corporation. Roleplay Overlay is not affiliated with, endorsed by, or sponsored by Roblox Corporation.

9. Service Availability

The Service is provided "as is" and "as available." We do not guarantee:

• Continuous, uninterrupted access to the Service
• That the Service will be error-free
• That any defects will be corrected
• Any specific uptime or availability

We may discontinue the Service at any time without notice.

10. Limitation of Liability

To the maximum extent permitted by applicable Spanish and European law:

• No Indirect Damages: Andalucía:RP shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of profits, or service interruption.
• Service Basis: The Service is provided free of charge. By using it, you agree that Andalucía:RP assumes no financial liability for issues arising from the use of the software, except in cases of willful misconduct (dolo) or gross negligence required by mandatory law.
• Hosting Provider: AraAraStudios, as the hosting provider, shall not be liable for any actions taken by the Operator (Andalucía:RP) or its users. Any legal claims regarding content or moderation must be directed solely to Andalucía:RP.

11. Indemnification

You agree to indemnify, defend, and hold harmless AndalucíaRP and its developers from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Service or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain.

In the event of a dispute, and in accordance with EU Consumer Protection laws, the jurisdiction shall be the courts of the user's place of residence (domicile).

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Theme Marketplace

The Service includes a Marketplace where users can download and share visual themes ("Themes").

14.1 User-Generated Content

By determining to upload a Theme to the Marketplace, you represent and warrant that:

• You own the copyright to the Theme or have explicit permission to share it.
• The Theme looks and functions as described.
• The Theme contains no malicious code, scripts, or exploits.
• The Theme does not contain offensive, NSFW, or prohibited content.

14.2 License Grant

By uploading a Theme, you grant Andalucía:RP a non-exclusive, worldwide, royalty-free license to host, distribute, and display the Theme to other users of the Service.

14.3 Content Removal

We reserve the right to remove any Theme from the Marketplace at our sole discretion, without notice or liability, especially if it violates these Terms or for technical reasons.

15. Roblox TOS Compliance - arpOverlay

14.1 Purpose of This Statement

This document exists to ensure maximum transparency, demonstrate good faith, and facilitate any review by moderators, administrators, or compliance teams.

14.2 Technical Nature of the Application

arpOverlay is an external and independent communication platform that offers:

• Text channels
• Voice communication
• Roleplay scenes, radio, and environments

The application:

• Does NOT run inside Roblox
• Does NOT modify the Roblox client
• Does NOT inject code
• Does NOT alter internal chat
• Does NOT interact with Roblox Voice Chat
• Does NOT access internal game data
• Does NOT use Roblox communication APIs

It operates equivalent to external platforms such as Discord, TeamSpeak, or independent voice services.

14.3 Relationship with Roblox

14.3.1 Authentication

The app uses Roblox OAuth 2.0 exclusively to:

• Verify basic user identity
• Prevent impersonation
• Securely associate accounts

The app does NOT access:

• Age information
• Biometric data
• Facial verification
• Documents
• Private settings
• Sensitive data

No password is requested nor is private information stored.

14.3.2 Independence

arpOverlay:

• Is NOT an official Roblox product
• Is NOT affiliated with Roblox
• Is NOT sponsored by Roblox
• Does NOT represent Roblox

It is an external and independent tool.

14.4 No In-Game Promotion

This ensures compliance with rules about not directing users outside the platform from within the game.

14.5 Communication and Security Standards

Roblox strictly regulates:

• Its internal chat
• Its voice chat
• Its filters
• Its age verification system

These rules apply exclusively within the Roblox platform.

arpOverlay:

• Does NOT use Roblox chat
• Does NOT use Roblox VC
• Does NOT access filters
• Does NOT interfere with internal systems

Therefore, there is no technical evasion of Roblox security systems.

14.6 Age Policy (+18)

The application is designed exclusively for adults. During access:

• Explicit +18 confirmation is requested
• If not accepted, the app cannot be used

No documentation is requested for reasons of:

• Privacy
• Data protection
• Legislation
• Security

This model is equivalent to many external social communication platforms. The app:

• Is NOT aimed at minors
• Does NOT allow access without confirmation
• Has active moderation

14.7 Moderation and Conduct

arpOverlay has:

• Report system
• Active moderators
• Conduct rules
• Incident logging
• Sanctions for abuse

The following is prohibited:

• Grooming
• Harassment
• Impersonation
• Illegal content
• Inappropriate conduct

This demonstrates responsibility and commitment to safety.

14.8 Potentially Applicable Roblox Rules

The following explains the rules that could be considered relevant and why the app does not violate them.

14.8.1 "Directing users outside Roblox"

This rule applies to: links within the game, in-game redirections, and GUIs with URLs. arpOverlay does none of these actions. Result: Full compliance.

14.8.2 "Evasion of security systems"

Roblox requires age verification and filters for its own chat and VC. The app does not use those systems, does not interfere with them, and does not technically replace them. It is an external platform, like Discord.

14.8.3 "Protection of minors"

The app is +18, requests confirmation, has moderation, and is not aimed at minors. There is no obligation in the TOS to verify age with documents in external apps.

14.8.4 "Use of Roblox trademark"

The app does not use official logos, does not present itself as an official product, and includes disclaimers. Result: Full compliance.

14.8.5 "Data collection"

The app does not request documents, does not store sensitive data, and does not access verified age. Result: Privacy compliance.

14.9 Difference Between Intent and Prohibition

Roblox aims to protect users, especially minors. However:

• The TOS regulate the use of Roblox
• They do not regulate external tools
• They do not prohibit Discord
• They do not prohibit overlays
• They do not prohibit external communication

There is no clause that explicitly prohibits the existence of this app.

14.10 Transparency and Cooperation

The arpOverlay team:

• Is open to dialogue
• Can make adjustments
• Will cooperate with any request
• Prioritizes safety

Our goal is not to evade rules, but to offer a useful, safe, and responsible tool.

14.11 Summary

Therefore: The application does not violate Roblox's Terms of Use or Community Guidelines in its current state.
